This Acceptable Use Policy ("AUP") governs your use of the Fanflet platform and Services. This AUP is incorporated into and forms part of the Fanflet Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.
1. Purpose
Fanflet enables Speakers to share professional resources with their audiences and Sponsors to reach engaged communities through trusted educators. This AUP ensures the platform remains safe, trustworthy, and useful for all users. Violations of this AUP may result in content removal, account suspension, or termination.

2. Prohibited Content
You may not upload, publish, or distribute content through the Services that:
2.1 Illegal or Harmful Content
- Violates any applicable law or regulation;
- Promotes, facilitates, or instructs on illegal activities;
- Contains or distributes child sexual abuse material (CSAM);
- Constitutes or facilitates human trafficking;
- Promotes terrorism or violent extremism; or
- Contains credible threats of violence against any individual or group.
2.2 Malicious Content
- Contains malware, viruses, trojans, ransomware, spyware, or other malicious code;
- Contains phishing links or deceptive login pages designed to steal credentials;
- Links to sites that distribute malware or engage in drive-by downloads;
- Contains scripts designed to mine cryptocurrency without user consent; or
- Includes executable files disguised as other file types (e.g., a .exe renamed to .pdf).
2.3 Infringing Content
- Infringes any third party's copyright, trademark, patent, trade secret, or other intellectual property rights;
- Contains content you do not have the right to distribute (e.g., pirated software, unauthorized copies of copyrighted materials); or
- Violates the terms of any license under which you received the content.
2.4 Deceptive Content
- Misrepresents your identity, qualifications, or professional credentials;
- Impersonates any person, organization, or entity;
- Contains false or misleading claims about products, services, or medical/health outcomes;
- Presents sponsored content as independent editorial content without disclosure; or
- Uses deceptive techniques to artificially inflate engagement metrics (click farms, bot traffic, etc.).
2.5 Abusive or Harassing Content
- Constitutes harassment, bullying, or intimidation;
- Contains hate speech targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics;
- Publishes private or personally identifiable information about others without consent (doxxing); or
- Is defamatory, libelous, or intended to damage the reputation of others through false statements.
2.6 Adult or Explicit Content
- Contains sexually explicit material, nudity, or pornography;
- Promotes adult services or escort services; or
- Contains gratuitous violence or gore unrelated to legitimate educational purposes.
2.7 Regulated and Restricted Content
- Promotes or sells controlled substances, illegal drugs, or drug paraphernalia;
- Promotes or facilitates the sale of firearms, weapons, or explosives in violation of applicable law;
- Promotes unregulated financial instruments, pyramid schemes, or fraudulent investment opportunities; or
- Offers medical advice, diagnosis, or treatment without appropriate professional credentials and disclaimers.

3. Prohibited Conduct
You may not use the Services to:
3.1 Platform Abuse
- Attempt to access another user's account, data, or fanflets without authorization;
- Circumvent, disable, or interfere with security features, rate limits, or usage restrictions;
- Reverse engineer, decompile, or disassemble any part of the Services;
- Use bots, scrapers, or automated tools to access the Services except through published APIs;
- Probe, scan, or test the vulnerability of the Services without written authorization;
- Create multiple accounts to circumvent plan limits, bans, or other restrictions; or
- Interfere with or disrupt the Services or the servers and networks that host them.
3.2 Data Abuse
- Scrape, harvest, or collect personal information of other users;
- Use Subscriber Data for purposes not authorized by the subscribing Audience Member;
- Sell, rent, or share Subscriber Data with third parties;
- Attempt to re-identify de-identified or aggregate data; or
- Access or use another Speaker's analytics data without authorization.
3.3 Communication Abuse
- Send unsolicited bulk communications (spam) to Audience Members or Subscribers;
- Use the platform to deliver marketing messages not related to the fanflet context;
- Send excessive SMS bookmark requests or encourage others to do so for the purpose of harassment; or
- Abuse transactional communications channels for promotional purposes.
3.4 Commercial Abuse
- Use the Services to operate a business that competes with Fanflet;
- Resell access to the Services without written authorization;
- Generate artificial traffic, clicks, or engagement metrics to deceive Sponsors; or
- Misrepresent analytics or engagement data to Sponsors or other third parties.

4. Content Standards for Uploaded Files
Because Speakers and Sponsors can upload files to the platform, the following standards apply to all uploaded content:
4.1 File Safety
- All uploaded files must be free of malware, viruses, and malicious code;
- Executable files (.exe, .bat, .sh, .cmd, .msi, .app, .dmg) are prohibited unless specifically enabled for your account;
- Files must not exceed the storage limits of your subscription plan; and
- Files must not be encrypted or password-protected in a manner that prevents Fanflet from scanning them if automated content scanning is implemented.
4.2 File Content
- Uploaded files are subject to the same content restrictions as all other content on the platform (see Section 2);
- File names and metadata must not contain offensive, misleading, or deceptive information; and
- Files must be relevant to the educational or professional context of the fanflet.
4.3 Intellectual Property
- You must own or have the right to distribute every file you upload;
- Presentation slides, documents, and images must not contain unlicensed copyrighted material (stock photos, music, video clips, etc.); and
- If you include third-party content under fair use or a license, you are responsible for compliance with the applicable terms.

5. Sponsor-Specific Standards
In addition to the general content and conduct rules above, Sponsors must:
- Ensure all Sponsor Content complies with applicable advertising laws and regulations, including FTC endorsement and disclosure guidelines;
- Clearly identify promotional content as sponsored — Fanflet provides platform-level labeling, but Sponsors share responsibility for compliance;
- Not use the platform to directly contact individual Audience Members or Subscribers;
- Ensure promotional claims are truthful, substantiated, and not misleading;
- Not upload content that promotes products or services prohibited by applicable law in the jurisdictions where the content will be displayed; and
- Maintain accurate and current company information in their sponsor profile.

6. Enforcement
6.1 Detection and Review
Fanflet may detect AUP violations through automated systems, user reports, manual review, or third-party notifications. We are not obligated to monitor all content but reserve the right to do so.
6.2 Actions
When Fanflet determines that a violation has occurred, we may take one or more of the following actions at our discretion:
- Warning — Notify you of the violation and request remediation;
- Content Removal — Remove or disable access to the offending content;
- Feature Restriction — Temporarily restrict access to certain features (e.g., file uploads, SMS sending);
- Account Suspension — Temporarily suspend your account pending investigation or remediation; or
- Account Termination — Permanently terminate your account for severe or repeated violations.
6.3 Severity Levels

6.4 Appeals
If you believe your content was removed or your account was suspended in error, you may submit an appeal to legal@fanflet.com within 30 days. Include a description of the content or conduct at issue and your basis for believing the action was taken in error. Fanflet will review appeals and respond within 14 business days.
6.5 Repeat Violations
Repeated violations will result in escalating enforcement actions. Three or more violations within a 12-month period may result in account termination regardless of individual violation severity.

7. Reporting Violations
If you encounter content on Fanflet that you believe violates this AUP, please report it to:

- The URL of the fanflet page where the violation appears (if applicable);
- Your contact information; and
- Any supporting evidence.
Fanflet will acknowledge reports within 48 hours and take appropriate action in accordance with Section 6.

9. Changes to This Policy
Fanflet may update this AUP from time to time. We will post the updated version with a new "Last Updated" date. Material changes will be communicated via email to account holders with at least 14 days' notice before taking effect. Continued use of the Services after changes take effect constitutes acceptance of the updated AUP.
